Parade of Playhouses Legal

This raffle is conducted by Family Violence Prevention Services, Inc., (“FVPS”) a private non-profit organization under Texas Law.  By purchasing a raffle ticket, you will be bound by the following rules:


  1. The purchase price for one raffle ticket is $5.00 or 5 for $20.00.
    2. All entry purchases are final and non-refundable.

 

  1. ELIGIBILITY: The raffle is open only to verifiable legal residents of the 50 United States and the District of Columbia, who are 18 years of age or older.4. All unsold tickets and proceeds from the raffle ticket sales, including any online sales, must be received by FVPS no later than 5:30 p.m. Central Time, Sunday, August 16, 2015. If received after the official deadline, all monies will be returned to Entrant(s) and all associated tickets will be invalid.

 

  1. The winner of the raffle will be determined by random drawing. The drawing will take place on Sunday, August 16, 2015, at approximately 8:30 p.m. Central Time at the FVPS offices at 7911 Broadway. This information will also be announced on the event’s website at www.saparadeofplayhouses.com.

  2. The winner is responsible for any and all federal, state, and local income or excise taxes, fees, assessments and like charges associated with the prize. All personal income taxes, sales or use taxes, or any other taxes whatsoever are the sole responsibility of the winner.
    7. Prize includes the playhouse and all attachments and decorations, if any, attached or set up as display with the playhouse.

 

  1. DELIVERY: Winner is responsible for prize delivery from mall. Considerations may be made for residents of Bexar County ONLY, where the prize is to be delivered to an address within no more than a 50 mile radius. FVPS is not responsible for prize utility, quality, or otherwise.  FVPS will coordinate logistics pertaining to removal of houses from mall premises.

 

  1. LIMITATION, LIABILITY AND DISCLAIMERS: The decision of FVPS relating to the winner, the interpretation of the Official Rules and other matters related to this Raffle are final. FVPS MAKES NO WARRANTY OF ANY NATURE WITH RESPECT TO THE RAFFLE OR THE PRIZE, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUALITY OR NON-INFRINGEMENT. ENTRANTS HEREBY ACKNOWLEDGE THAT, EXCEPT AS SPECIFICALLY SET FORTH HEREIN, FVPS HAS NOT MADE ANY WARRANTY AND DISCLAIMS ALL LIABILITY FOR ANY WARRANTY OR LIABILITY RELATING TO THE RAFFLE, THE DRAWING, TRANSPORTATION, AND USE OF THE PRIZE WHETHER IN LAW OR FACT, CONTRACT OR TORT. ALL ENTRANTS, BY ENTERING THIS RAFFLE, AGREE TO BE BOUND BY THESE OFFICIAL RULES. BY ACCEPTING THE PRIZE, THE WINNER AGREES TO RELEASE, DEFEND AND INDEMNIFY FVPS, ITS DIRECTORS, EMPLOYEES, AGENTS, OFFICERS AND ALL OTHERS PARTICIPATING WITH FVPS IN THE PROMOTION OF THE RAFFLE, FROM ANY AND ALL LIABILITY, LOSS OR PERSONAL OR PROPERTY DAMAGE, INCLUDING PERSONAL INJURY OR DEATH, ARISING OUT OF OR RELATED TO, DIRECTLY OR INDIRECTLY, THE AWARDING, RECEIPT, ACCEPTING, DELIVERY, TRANSPORTING, USING OR MISUSING OF THE PRIZE AND PARTICIPATION IN ANY PRIZE-RELATED ACTIVITY.

 

 

  1. PROCEEDS: All proceeds benefit The Battered Women and Children’s Shelter of Bexar County. Regular donations can be made to The Battered Women and Children’s Shelter, 7911 Broadway, San Antonio, TX 78209.11. The winner of the raffle must claim the prize within 48 hours upon telephonic or email notification and coordinate with FVPS for its removal from the mall’s property within 4 days (NO LATER THAN 10:00 AM, AUG 21, 2015) following notification, otherwise FVPS will make arrangements to remove it at sole winner’s cost and store it for 14 days. If the winner does not claim the prize within 14 days after removal from the mall, the prize will be forfeited. FVPS will not be responsible for land preparation or any costs related to the disposition, placement, or relocation of the prize on behalf of the winner.

 

  1. Any and all disputes or claims related to the matters addressed herein shall be settled by arbitration in San Antonio, Texas, administered by the American Arbitration Association under its applicable rules or procedures.
